TERMS AND CONDITIONS

These Terms and Conditions set out the terms applicable to medical packages arranged by Clinic Center.

Please read these Terms and Conditions carefully, together with any documents referred to in them. By accepting these Terms and Conditions, you confirm that you have read and understood them and agree to comply with them.

Clinic Center may amend or update these Terms and Conditions from time to time where reasonably necessary. Any changes affecting an existing booking will be communicated to the patient where required by applicable law.

1. DEFINITIONS

Clinic Center: Clinic Center, the company arranging and coordinating the Medical Package selected by the patient.

Treatment Provider: The doctor, surgeon, clinic, hospital or other medical institution responsible for providing the medical treatment.

Medical Package: The package selected by the patient, which may include medical treatment, accommodation, transfers, hosting services and other services specifically stated in the patient’s treatment plan or booking confirmation.

Treatment: The medical procedure or treatment to be provided by the selected Treatment Provider.

2. CLINIC CENTER’S RESPONSIBILITIES

  1. Clinic Center coordinates and supports the patient’s treatment journey, including communication with the Treatment Provider, appointment coordination, accommodation and airport transfer arrangements, and other services included in the Medical Package.
  2. Clinic Center assists the patient throughout the process and facilitates communication between the patient and the Treatment Provider. Clinic Center is responsible for the coordination and organisation of the services it directly provides as part of the Medical Package.
  3. The medical treatment is provided and performed by the selected Treatment Provider. The Treatment Provider is responsible for the clinical assessment, diagnosis, medical decisions, treatment plan, surgical or medical procedure, and clinical care provided to the patient.
  4. Clinic Center does not provide medical treatment and does not make clinical decisions on behalf of the Treatment Provider. Accordingly, Clinic Center is not responsible for the medical acts, omissions, clinical decisions, treatment outcomes, complications or malpractice of the Treatment Provider, except where liability cannot legally be excluded.
  5. Clinic Center will remain available to assist the patient with communication and coordination throughout the treatment process. Where the patient raises a medical concern, Clinic Center will facilitate communication with the relevant Treatment Provider so that the matter can be assessed and addressed by the appropriate medical professional.
  6. The treatment plan and package provided before the patient’s arrival may be based on photographs, medical information, test results and other information supplied by the patient. The final treatment plan may therefore change following an in-person medical assessment or examination by the Treatment Provider.
  7. If additional examinations, tests, procedures or treatments are considered medically necessary following the patient’s assessment, any additional costs will be payable by the patient unless otherwise agreed in writing.
  8. If a treatment or service included in the Medical Package is not provided, any applicable refund will be assessed in accordance with the patient’s booking terms and the value of the service not provided.
  9. Clinic Center will provide the patient with the relevant information concerning their Medical Package before travel, which may include:
  • The name and contact details of the Treatment Provider;
  • The name and contact details of the hotel, where accommodation is included;
  • The name and contact details of the host, where hosting services are included;
  • The name and contact details of the driver or transfer company, where transfers are included;
  • The confirmed treatment date and time.

10. Where services are provided by independent third-party providers, Clinic Center will use reasonable efforts to coordinate these services and assist the patient with any communication or arrangements relating to them. The relevant third-party provider remains responsible for the services it directly provides, subject to applicable law.

3. PATIENT’S RESPONSIBILITIES

  1. The patient must provide complete and accurate information regarding their medical history, current health condition, medication, allergies, previous procedures and any other information relevant to their treatment.
  2. The patient is responsible for informing Clinic Center and the Treatment Provider of any change in their medical condition or circumstances that may affect their treatment.
  3. The patient acknowledges that incomplete, inaccurate or withheld medical information may affect their treatment plan and may result in changes to, postponement of or cancellation of the planned treatment.
  4. The patient is responsible for following the medical and pre-treatment instructions provided by the Treatment Provider.
  5. The patient is responsible for ensuring that they have all necessary travel documents, including a valid passport, visa and any other documents required for travel.
  6. Clinic Center does not arrange visas or guarantee entry into Türkiye. The patient is responsible for ensuring that they are legally permitted to travel to Türkiye for treatment.
  7. By accepting these Terms and Conditions, the patient authorises Clinic Center, where reasonably necessary and subject to applicable data protection laws, to obtain relevant medical records from the Treatment Provider and retain such records for legitimate business, administrative, legal and aftercare purposes.
  8. A deposit must be paid to Clinic Center to confirm and secure the patient’s booking. Unless otherwise agreed in writing, the remaining balance must be paid in full before the treatment is performed.
  9. The full treatment balance must be settled before the treatment is performed. Clinic Center and/or the Treatment Provider may postpone the treatment where the required payment has not been completed.
  10. The patient is responsible for obtaining any travel, medical or other insurance they consider appropriate. Unless expressly stated otherwise in writing, insurance is not included in the Medical Package.

4. FLIGHT ARRANGEMENTS

After the patient’s treatment date has been confirmed, Clinic Center’s travel team will assist with coordinating the patient’s travel arrangements.

Patients must not purchase flight tickets before consulting their assigned Clinic Center travel coordinator where flight arrangements are included or coordinated as part of their Medical Package.

The travel coordinator will support the patient throughout the booking process to ensure that flights are arranged in accordance with the confirmed treatment schedule.

Patients are required to remain in contact with their coordinator and provide any information reasonably required until the flight booking process has been completed.

Flights Included in All-Inclusive Packages

Where a flight is specifically included in an All-Inclusive Package:

  1. Flight arrangements must be made through the patient’s Clinic Center travel coordinator.
  2. To qualify for the included flight benefit, the flight arrangements must be completed at least 45 days before the scheduled treatment date.
  3. Clinic Center will cover the cost of the lowest-priced suitable flight option available that is reasonably compatible with the confirmed treatment schedule and the terms of the Medical Package.
  4. The patient must accept the flight option selected in accordance with the package terms. If the patient chooses a more expensive flight or requests additional services, any additional cost will be payable by the patient.
  5. Clinic Center will not reimburse flights purchased independently by the patient unless this has been approved by Clinic Center in writing before purchase.

5. CANCELLATION AND REFUND POLICY

Patients may request cancellation of their treatment booking at any time, subject to the terms applicable to their booking and any applicable legal rights.

Where a refund is due, any non-recoverable third-party costs specifically incurred for the patient’s booking may be deducted where permitted by applicable law.

Eligible refunds will normally be processed at the beginning of the following month.

Deposit

The deposit is non-refundable in the following circumstances:

  • The cancellation is made less than one month before the scheduled treatment date;
  • The cancellation takes place after flight tickets have been issued;
  • The booking was made under a promotional or special campaign offer stating that the deposit is non-refundable;
  • Any other non-refundable condition expressly agreed with the patient at the time of booking.

Nothing in this section is intended to exclude or restrict any mandatory rights the patient may have under applicable law.

6. FEEDBACK, REVIEWS AND PUBLIC STATEMENTS

Clinic Center welcomes honest and genuine feedback from its patients and values feedback that helps improve the services provided.

Patients are entitled to share their genuine experiences, opinions and complaints regarding the services they receive.

Public statements or reviews concerning Clinic Center, its employees, Treatment Providers or associated services should be based on the patient’s genuine experience and should not knowingly contain false, fabricated or materially misleading factual information.

Where there is a reasonable basis to believe that a public statement contains false factual allegations, fabricated claims, deliberate misinformation, impersonation, harassment, threats or other unlawful content, Clinic Center may review the matter and contact the patient to request clarification or supporting information.

Where appropriate, Clinic Center may request the correction or removal of content that is found, following reasonable assessment, to contain false or unlawful factual claims.

Nothing in these Terms and Conditions prevents a patient from expressing a genuine opinion, making a genuine complaint or exercising any legal rights available to them.

Where Clinic Center reasonably believes that published content is unlawful or causes legally actionable harm, Clinic Center reserves the right to pursue appropriate legal remedies in accordance with applicable law.

7. CONFIDENTIALITY AND PERSONAL DATA

  1. Clinic Center will take reasonable steps to protect the patient’s personal information and process personal data in accordance with applicable data protection legislation and Clinic Center’s Privacy Policy.
  2. Before-and-after photographs may only be used by Clinic Center for marketing, educational or promotional purposes where the patient has provided the appropriate separate consent required under applicable law.
  3. Where the patient has provided the relevant marketing consent, Clinic Center and its authorised affiliates or partners may contact the patient by telephone, SMS and email regarding products, services, offers and other opportunities, in accordance with the applicable Privacy Policy and data protection laws.
  4. Patients may withdraw their marketing consent at any time in accordance with the Privacy Policy.

8. THIRD-PARTY SERVICES

Where a Medical Package includes services provided by third parties, including Treatment Providers, hospitals, hotels, airlines or transfer companies, those services may be subject to the terms and conditions of the relevant third-party provider.

Clinic Center will use reasonable efforts to coordinate these services and assist the patient throughout the process.

Each third-party provider remains responsible for the services it directly provides, subject to applicable law.

9. MEDICAL COMMUNICATION AND AFTERCARE

  1. Clinic Center will assist the patient with communication with the Treatment Provider before, during and after the treatment where such coordination is included in the Medical Package.
  2. Where the patient reports a medical concern following treatment, Clinic Center will facilitate communication with the relevant Treatment Provider so that the concern can be assessed by the appropriate medical professional.
  3. Clinic Center does not provide medical diagnosis, medical advice or clinical treatment. Any medical assessment, diagnosis, advice, prescription, treatment or clinical decision must be provided by an appropriately qualified medical professional.
  4. Any online or local aftercare services included in the Medical Package are intended to support communication and coordination with the relevant medical provider and do not replace medical assessment or treatment by the Treatment Provider.

10. JURISDICTION AND APPLICABLE LAW

These Terms and Conditions shall be interpreted in accordance with applicable law.

To the extent permitted by applicable law, disputes arising from or relating to these Terms and Conditions shall be subject to the jurisdiction of the competent courts and enforcement offices of Istanbul, Türkiye.

Nothing in this clause is intended to prevent a consumer from exercising any mandatory rights or remedies available to them under applicable consumer protection law.

11. GENERAL PROVISIONS

  1. If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it valid and enforceable, where legally possible. The remaining provisions shall continue to apply.
  2. These Terms and Conditions, together with the patient’s treatment plan, booking confirmation, package details and any other documents expressly incorporated into the booking, constitute the agreement between the patient and Clinic Center in relation to the services arranged by Clinic Center.
  3. Nothing in these Terms and Conditions is intended to exclude or limit any liability, right or remedy that cannot lawfully be excluded or limited under applicable law.
